Who Can Make a Will and How to Do It?
All individuals who are able to express their intent and have full capacity to perform legal transaction can make a will. They must write the document in person, without any assistance. The safest form of a will for the testator, and the one we recommend, is a notarial deed. Making a will in the presence of a notary - whether it takes place in a notary's office or elsewhere - ensures the greatest certainty of implementing the testator's last will. In accordance with the law, a will can also be oral or handwritten and signed by the testator.
